Legal representation
in Brazil for global platforms.
ECA Digital (Law No. 15.211/2025) and Decree No. 12.975/2026 have changed the rules: every foreign digital platform operating in Brazil must appoint a legal representative established in the country — empowered to respond to subpoenas, notices, and judicial and administrative proceedings.
It is not optional. And the cost of non-compliance is high: fines of up to 10% of the group's revenue in Brazil, capped at BRL 50 million per infraction, plus suspension or prohibition of activities.

A new regulatory framework for digital platforms.
Law No. 15.211/2025 (ECA Digital) was regulated by Decree No. 12.880/2026, which structures the National Policy for the Protection of Children and Adolescents in the Digital Environment.
In May 2026, Decree No. 12.975/2026 reinforced, also for internet providers in general, the obligation to appoint a legal representative in Brazil — consolidating this requirement on two regulatory fronts.

The Law, the obligation, and the risk.
The Law
The Obligation
Foreign suppliers of digital products or services subject to the law must designate a legal representative in Brazil, constituted as a legal entity, with powers to respond to regulatory obligations before the competent authorities.
The Risk
Non-compliance exposes the company to fines of up to 10% of the group's revenue in Brazil (capped at BRL 50 million per infraction), suspension of activities, prohibition of operating in the country, and judicial liability of executives.
